Terms of Service

These terms apply to every order placed at luviacycle.com. By placing an order, you agree to them.

1. Who we are

2. Definitions

We / us: D&A Direct Delivery, trading as Luvia Cycle.
You / customer: the person who places an order with us.
Consumer: a customer who does not buy in the course of a business.
Products: the items offered in our store, including period underwear, continence underwear and period swimwear.

3. Our products

We describe our products, sizes and absorbency levels as accurately as we can. Colours and images may differ slightly from the actual product. Obvious errors in descriptions or prices do not bind us.

Our products are reusable underwear and swimwear, not medical devices. Absorbency and wear time depend on your flow; please follow the guidance on each product page. Follow the care instructions to keep your products working well. Damage caused by washing or drying outside these instructions is not covered under our warranty.

4. Orders and contract

Your order is an offer to buy. A contract is formed when we send you an order confirmation email. We may refuse or cancel an order for valid reasons, for example suspected fraud, a pricing error or limited stock. If we cancel, we'll refund any payment in full.

5. Prices and payment

Prices are shown in AUD or NZD and include GST where applicable. Shipping costs are shown at checkout before you pay. Import duties or taxes not collected at checkout are your responsibility (see our Shipping Policy).

We accept the payment methods shown at checkout, including major cards and PayPal. Payment is due when you place your order.

6. Delivery

We deliver to Australia and New Zealand within the times in our Shipping Policy. If we can't deliver within 30 days of your order, we'll let you know, and you may cancel for a full refund. Risk passes to you once the order is delivered to your address.

7. Returns, exchanges and right of withdrawal

You may exchange items for a different size within 30 days, or return items for a refund within 14 days of delivery, as described in our Refund & Exchange Policy.

For hygiene reasons, worn, washed or used items and items returned without tags or hygiene liner cannot be returned, unless they are faulty.

8. Warranty and consumer guarantees

Our products must match their description and be of acceptable quality. If a product is faulty, please contact us as described in our Refund & Exchange Policy.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993. Nothing in these terms limits any rights you have under those laws or any other consumer law that applies to you.

9. Liability

To the extent permitted by law, our liability is limited to the purchase price of the product concerned. We are not liable for indirect loss, or for damage caused by misuse, alterations or not following the care instructions.

10. Complaints

If you have a complaint, email info@luviacycle.com with your order number and a description of the issue. We'll acknowledge it within 2 business days and aim to resolve it within 14 days. If it takes longer, we'll tell you when you can expect an answer.

11. Marketing messages

If you opt in to our email or SMS marketing, you agree to receive recurring promotional and personalised messages. Consent is not a condition of purchase. You can opt out at any time via the unsubscribe link or by replying STOP to an SMS. See our Privacy Policy for details.

12. Payment data (CESOP)

Under EU rules, payment service providers may report certain payment data to the Central Electronic System of Payment Information (CESOP).

13. Governing law

These terms are governed by Dutch law. This does not take away the protection you have under the mandatory consumer laws of the country where you live, including Australia and New Zealand.
